Terms of Service

These Terms of Service ("Terms") govern your access to and use of Metrone, a privacy-first web analytics and AI feature tracking platform operated by Metrone Inc. By creating an account or using the service, you agree to these Terms.

1. Account Terms

• You must be at least 16 years old to use Metrone.
• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One person or organization may maintain multiple accounts, but each site may only be associated with one account at a time.

2. Service Description

Metrone provides privacy-first web analytics and AI feature tracking. We collect page views, custom events, and AI interaction events from your websites and applications. All data is processed at our global edge network and stored in our managed database infrastructure. We do not use cookies, store IP addresses, or collect personal identifying information about your visitors.

3. Acceptable Use

You agree not to use Metrone to:

• Violate any applicable law or regulation
• Send analytics events that contain personal data, health information, or financial data in event names or properties
• Attempt to reverse-engineer visitor identity from aggregated analytics data
• Interfere with or disrupt the integrity or performance of the service
• Attempt to gain unauthorized access to the service or its related systems
• Use the service to build a competing product or benchmark against competitors without permission

We reserve the right to suspend or terminate accounts that violate these terms, with notice when practicable.

4. Payment Terms

• Paid plans are billed in advance on a monthly or annual cycle via Stripe.
• All fees are in US dollars and non-refundable except where required by law.
• If your usage exceeds your plan's included page views, you will be charged overage fees at the rate specified on your plan's pricing page.
• We will notify you before charging overage fees that exceed 20% of your base plan cost.
• Failure to pay may result in service downgrade or suspension after a 14-day grace period.
• You may upgrade, downgrade, or cancel your plan at any time. Changes take effect at the start of the next billing cycle.

5. Data Ownership

You own your data. All analytics data collected through Metrone for your websites belongs to you. We do not sell, share, or monetize your analytics data in any way. We access your data only to provide the service, maintain infrastructure, and respond to support requests you initiate.

You may export or delete your data at any time through your dashboard or by contacting us. Upon account termination, we will delete your data within 30 days unless a longer retention period is required by law.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Planned maintenance windows will be communicated at least 48 hours in advance when possible.

Formal Service Level Agreements (SLAs) with uptime guarantees and financial credits are available exclusively on Scale and Enterprise plans. Free and Starter plan users receive best-effort availability.

7. Intellectual Property

Metrone and its original content, features, and functionality are owned by Metrone Inc. and are protected by applicable intellectual property laws. Our name, logo, and branding may not be used without prior written consent.

The Metrone tracking script and any open-source components we publish are licensed under their respective open-source licenses.

8. Limitation of Liability

To the maximum extent permitted by law, Metrone Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the service.

Our total aggregate liability for any claims arising from these Terms or the service shall not exceed the amount you paid to Metrone in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Metrone Inc. from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• You may close your account at any time from your dashboard settings.
• We may terminate or suspend your account for material breach of these Terms after providing 14 days' written notice, except in cases of illegal activity where immediate termination may apply.
• Upon termination, your right to use the service ceases immediately.
• We will retain your data for 30 days post-termination to allow retrieval, after which it is permanently deleted.

11. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of Metrone after changes become effective constitutes acceptance of the revised Terms. If you disagree with the changes, you may close your account before they take effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
